NY High Court Reverses Midland Choice-Of-Law Dispute

Law360, New York (April 6, 2011, 9:40 PM EDT) -- New York's highest court on Tuesday reversed a ruling finding the liquidator for insolvent Midland Insurance Co. must decide choice-of-law disputes between policyholders and the New York State Liquidation Bureau solely under New York law.

The New York State Court of Appeals reversed an Appellate Division decision and agreed with the Supreme Court of the State of New York’s ruling that a liquidator for Midland erred when it only applied New York law in deciding which clams to disallow.
