High Court Passes On Power Plant Pollution Case

Law360 (April 30, 2007, 12:00 AM EDT) -- The federal Clean Air Act has taken center stage once again, with the U.S. Supreme Court declining to hear the Bush administration’s appeal of a controversial rule that seeks to exempt older factories from certain anti-pollution controls.

On Monday, the High Court denied certiorari in the case, allowing the decision handed down by the U.S. Court of Appeals for the District of Columbia that struck down key parts of the Environmental Protection Agency’s rule to stand.
