Minsurg Infringement Claims Survive Dismissal Bid

Law360 (April 7, 2011, 5:38 PM EDT) -- A federal judge in Florida on Wednesday refused to dismiss Minsurg International Inc.'s claims that VG Innovations Inc. and Medtronic Inc. unit Osteotech Inc. infringed patents related to a back surgery system, but threw out Minsurg's Lanham Act, unfair competition and defamation claims.

Judge Virginia M. Hernandez Covington of the U.S. District Court for the Middle District of Florida ruled that Minsurg's complaint, filed in July, sufficiently alleges that surgical systems marketed by VG and Osteotech infringe the patents for Minsurg's TruFuse back surgery system....
