Bencor Loses Appeal Of $5M In Claims In Marketing Row

Law360, New York (April 7, 2011, 7:09 PM EDT) -- A Texas appeals court on Thursday upheld a trial court's decision to toss claims from benefits plan provider Bencor Inc., which alleged that Variable Annuity Life Insurance Co. owed an estimated $5.4 million in compensation following the end of their contract to market retirement plans.

The Texas Court of Appeals for the First District affirmed the trial court's decision to knock down Bencor's claims, denying its cross-motion for summary judgment and awarding VALIC attorneys’ fees.
