Devon Energy Loses Jurisdiction Fight In Cleanup Spat

Law360, New York (April 8, 2011, 5:48 PM EDT) -- A Texas appeals court ruled Thursday that Devon Energy Co. could not pursue a complaint over disputed environmental cleanup costs at a New York site in Texas courts, remanding the suit and ordering that it be tossed.

The 14th Court of Appeals in Houston rejected Devon Energy's argument that Motor Components LLC and BAM Enterprises Inc. could be sued as successors to Purolator Products Co., which had substantial business in Texas, as well as its argument that the companies had placed themselves under Texas jurisdiction by...
