Hawaii Exits NY Suit Over AmEx Merchant Policies

Law360 (April 8, 2011, 5:03 PM EDT) -- The state of Hawaii on Thursday dropped out of a suit pending in a New York federal court that alleges American Express Co.'s merchant discount fee rules violate antitrust laws.

Hawaii filed a stipulation signed by AmEx and the remaining plaintiffs in the suit, which include the U.S. Department of Justice and 17 other states, dismissing Hawaii's antitrust claims against AmEx without prejudice. The stipulation did not explain why Hawaii opted to drop its claims.
