Law360, New York (April 11, 2011, 7:17 PM EDT) -- An attorney for a white firefighter told the Second Circuit on Monday that Mt. Vernon, N.Y., passed over his client for a promotion because it was worried about litigation, as in the 2009 U.S. Supreme Court case Ricci v. DeStefano.
