4th Circ. Won't Revive DuPont Teflon Suit

Law360, New York (April 8, 2011, 7:07 PM EDT) -- The Fourth Circuit on Friday upheld a ruling in favor of DuPont Co. on common law tort claims in a putative class action over contamination of West Virginia drinking water with a hazardous Teflon compound.

A three-judge panel of the U.S. Court of Appeals for the Fourth Circuit affirmed summary judgment for DuPont and tossed plaintiffs' appeal of a lower court's denial of class certification on medical monitoring claims.

The panel also agreed with DuPont that the Fourth Circuit lacked jurisdiction to field the certification issue...
