Managers Win Cond. Cert. In Valspar FLSA Case

Law360, New York (April 11, 2011, 8:05 PM EDT) -- A federal judge in Minnesota on Monday granted conditional certification to current and former territory managers who claim paint maker Valspar Corp. failed to pay them for overtime hours.

Judge Richard H. Kyle of the U.S. District Court for the District of Minnesota signed off on an order granting the plaintiffs' bid for conditional collective action certification and giving them a green light to send out notice to potential members of the collective group.
