CIT Affirms Results Of Chinese Garlic Duty Review

Law360 (April 12, 2011, 6:19 PM EDT) -- The U.S. Court of International Trade on Tuesday rejected Jinan Yipin Corp. Ltd.'s challenge to the results of an administrative review of anti-dumping duties on garlic from China, ruling that the U.S. Department of Commerce's calculations were supported by law.

Judge Timothy C. Stanceu ruled that Commerce's selection of a surrogate value for garlic from India for use in the review was supported by the evidence.

The judge also granted a request by Commerce to remand the case so that the agency can redetermine its valuation...
