Insurers Carp Over $7M Fish Poisoning Suit

Law360, New York (April 13, 2011, 2:21 PM EDT) -- A $7 million lawsuit from a patron at Rubio's Restaurant Inc. who became ill after eating fish sparked another legal battle in California on Monday over whether the insurers for Rubio's or its fish supplier must foot the bill.

National Union Fire Insurance Co. of Pittsburgh, Pa., which insured Rubio's, filed its lawsuit in the U.S. District Court for the Southern District of California, saying Nationwide Mutual Insurance Co., which insured fish supplier Alfa International Seafood Inc., should exhaust its policy limits to cover any damages...
