TVA To Pay Up To $5B In EPA Emissions Deal

Law360, New York (April 14, 2011, 2:01 PM EDT) -- The Tennessee Valley Authority will pay a $10 million penalty, retire 18 coal-fired power generating units and install $3 billion to $5 billion in pollution controls as part of a deal announced Thursday.

The agreement resolves alleged Clean Air Act violations that the U.S. Environmental Protection Agency initially asserted against the TVA in 1999 as well as legal challenges brought by four states and three environmental groups. A companion consent decree was lodged in the U.S. District Court for the Eastern District of Tennessee.
