Circuit Clears Microsoft, HP In Smart Card Case

Law360, New York (May 2, 2007, 12:00 AM EDT) -- Microsoft Corp. and Hewlett-Packard Co. do not infringe a smart card company’s patent for user verification technology because the patent only covers cards and not devices such as handheld computers, an appeals court ruled Wednesday.

The U.S. Court of Appeals for the Federal Circuit denied E-Pass Technologies Inc.’s claim that a lower court misconstrued a claim construction for its patent for storing information from various sources, such as credit cards, on one multi-function card.
