NH Can Deduct Premium From Pensions, Court Rules

Law360, New York (April 14, 2011, 6:42 PM EDT) -- New Hampshire's highest court on Thursday upheld a ruling that it was not illegal for the state retirement system to deduct $65 from early retirees' pensions to pay premiums for their health insurance.

The Supreme Court of New Hampshire found that retirees had a contractual right to their pension payments, and the premium deductions impaired those payments. However, the impairment was not substantial, so the state was within its rights to make the mandatory deductions, it said.
