Ex-H&R Agent Loses Bid For Quick Win In OT Action

Law360 (April 15, 2011, 12:39 PM EDT) -- A former H&R Block tax agent lost a motion for partial summary judgment Thursday in a conditionally certified class action in Florida accusing the tax preparation specialist of failing to pay overtime in accordance with the Fair Labor Standards Act.

Plaintiff Joaquin Illano sought a ruling from Judge James Lawrence King of the U.S. District Court for the Southern District of Florida that H&R Block had actual and constructive knowledge of his performing overtime work without proper compensation, and authorized, required or permitted off-the-clock work....
