Transport Co. Can't Shake Benzene Suit V. Shell, Others

Law360, New York (April 18, 2011, 8:05 PM EDT) -- A New York state judge last week denied a transportation company's bid to duck out of a mechanic’s suit against Shell Oil Co. and several others, alleging he suffered injuries from benzene exposure after working with their products.

In an order made public April 11, Judge Joan Kenney ruled that it was too early to allow Island Transportation Corp. to escape the suit, saying the parties hadn't fully addressed whether the company actively distributed benzene-containing products during plaintiff John McCormack’s alleged exposure.
