Mich. Hospitals Try To Nix Price-Fixing Action

Law360, New York (April 19, 2011, 2:37 PM EDT) -- A group of Michigan hospitals asked a federal court Monday to dismiss a proposed antitrust class action filed by the city of Pontiac alleging a conspiracy between the hospitals and Blue Cross Blue Shield of Michigan to charge higher prices for services.

In the Monday request the hospitals argued that the lawsuit tries to “break new legal ground” and disregards recent U.S. Supreme Court jurisprudence, improperly wielding a per se theory of liability under federal antitrust law.
