New Oil Refinery Faces Challenge From Tribe

Law360 (May 3, 2007, 12:00 AM EDT) -- An energy company has temporarily postponed construction of the first new U.S. oil refinery in more than 30 years in light of a lawsuit that says the project would destroy artifacts and other Native American cultural resources.

In an order issued last month, Judge James A. Teilborg of the U.S. District Court in Phoenix approved Arizona Clean Fuels Yuma LLC’s voluntary stipulation to not conduct any ground disturbing activities before June 30 or until the court rules on a preliminary injunction motion.
