High Court Mulls Vt. Limits On Use Of Drug Data

Law360 (April 26, 2011, 7:40 PM EDT) -- The U.S. Supreme Court heard arguments Tuesday in a fight over a Vermont law curbing commercial use of pharmaceutical prescription data, with justices asking if the law was meant to thwart the sale of brand-name drugs.

The high court is mulling Vermont's challenge to a Second Circuit ruling that found the state's Prescription Confidentiality Law, which allowed data linking doctors to the medicines they prescribe to be sold for marketing only with physicians' consent, violated the First Amendment.
