Yahoo Gets 2nd Shot To Nix $12.4M Online Ad IP Verdict

Law360, New York (April 22, 2011, 6:36 PM EDT) -- The Federal Circuit on Friday ruled that a reasonable jury could not have found Yahoo Inc. guilty of infringement in Creative Internet Advertising Corp.'s $12.4 million suit over an online advertising patent.

It is undisputed that Yahoo’s system does not alter existing messages and does not intercept them with a server, a three-judge panel said. Accordingly, there was insufficient evidence for a reasonable jury to conclude that Yahoo Messenger infringed the patent under the doctrine of equivalents, it ruled.
