FDA To Repackage E-Cigarettes As Tobacco Products

Law360, New York (April 25, 2011, 7:05 PM EDT) -- The U.S. Food and Drug Administration announced Monday that it would begin a rulemaking process as ordered by the D.C. Circuit to treat electronic cigarettes as tobacco products rather than medical devices.

In a letter to e-cigarette makers and other stakeholders, the FDA said it would comply with the jurisdictional lines established by the D.C. Circuit in December and launch a rulemaking process to bring the nicotine devices under the "tobacco products" umbrella in the Family Smoking Prevention and Tobacco Control Act.
