Hospital Group To Appeal PPACA Suit Dismissal

Law360 (April 26, 2011, 9:08 PM EDT) -- Physician Hospitals of America said it would appeal a Texas federal judge's decision dismissing its suit claiming the Patient Protection and Affordable Care Act violates their constitutional rights by curtailing physician owner referrals for Medicare services.

The trade association, along with co-plaintiff Texas Spine & Joint Hospital Ltd., announced their intention Monday to take the case to the Fifth Circuit and seek an invalidation of Section 6001 of the health care reform legislation.
