U.S. Constitution Bars Canadian Drug Imports, Research Paper Argues

Law360 (October 22, 2004, 12:00 AM EDT) -- Lost in the debate between U.S. President George W. Bush and Democratic challenger John Kerry over the reimportation of prescription drugs from Canada are constitutional restraints protecting patent holders, according to a new research paper.

Kerry has accused Bush of breaking a 2000 campaign pledge to allow imports of cheaper prescription drugs from Canada and says the president is resisting the move to protect the big drug companies' profits.
