NAIC Wins Suit Over Medicare Supplement Criticisms

Law360, New York (April 28, 2011, 3:36 PM EDT) -- The National Association of Insurance Commissioners won summary judgment in a false advertising suit against it Wednesday, when a Texas federal judge reiterated his earlier ruling that its criticism of a Medicare supplement program was protected, noncommercial speech.

USA Senior Care Network Inc., whose business involves negotiating with hospitals for waivers of inpatient deductibles on behalf of insurers, sued the NAIC in October, alleging it violated the Lanham Act by saying the arrangement violated federal and state insurance regulations.
