Polypore Takes FTC Divestiture Order To 11th Circ.

Law360, New York (April 28, 2011, 6:47 PM EDT) -- Polypore International Inc. urged the Eleventh Circuit on Tuesday to overturn a Federal Trade Commission ruling that it must sell off the assets of Microporous Products LP, which the battery component maker acquired for $76 million in 2008, because of antitrust concerns.

In November, the FTC unanimously upheld an administrative law judge's finding that Polypore's acquisition of Microporous was anti-competitive and violated federal antitrust laws. The agency therefore ordered the company to unwind the deal and to divest all Microporous assets, including manufacturing plants in Piney...
