Judge Sees No Infringement In Elan's Apple ITC Case

Law360 (May 2, 2011, 6:20 PM EDT) -- A U.S. International Trade Commission administrative law judge ruled Friday in a Section 337 case over touch-screen technology that Elan Microelectronics Corp. failed to prove that Apple Inc. had infringed its patent.

Chief Administrative Law Judge Paul Luckern filed a final initial determination saying Elan failed to show that four claims of Elan's patent were infringed and that the evidence established that Apple had not run afoul of Section 337 of the Tariff Act of 1930. The initial determination is subject to ITC review.
