US Looks To Join EMC Qui Tam FCA Suit

Law360, New York (May 2, 2011, 11:03 PM EDT) -- Education Management Corp. announced Monday that the federal government has requested to intervene in a Pennsylvania whistleblower suit alleging that the company's policy of tying admissions officers' pay to the number of students enrolled violated the state's False Claims Act.

Education Management believes that several states will join the government in the qui tam suit in the Western District of Pennsylvania that also alleges violations of the Higher Education Act, according to a filing by the company with the U.S. Securities and Exchange Commission.
