Polish Antitrust Watchdog Gets Boost From EU High Court

Law360, New York (May 3, 2011, 12:27 PM EDT) -- National competition regulators in Europe cannot issue decisions clearing companies of wrongdoing under the European Union's antitrust laws, the bloc's highest court ruled Tuesday, backing Poland's watchdog in a case involving the country's dominant telecommunications provider.

The decision comes on a request from Poland's Supreme Court for advice on an appeal brought by the country's Office of Competition and Consumer Protection seeking to overturn two lower court rulings that the agency should have issued a decision clearing Telekomunikacja Polska SA of any wrongdoing under the EU...
