Calif. Appeals Court Revives Enviro Suit Against USG

Law360, New York (May 4, 2011, 8:03 PM EDT) -- A California appeals court ruled Tuesday that a lower court erred when it tossed the Sierra Club's challenge to the expansion and modernization of USG Corp.'s wallboard manufacturing plant in southern California.

No reasonable justification supported dismissal of the Sierra Club's petition for a writ of mandate directing Imperial County, Calif., to set aside an environmental impact report as inadequate and to revoke approval for USG's project, according to the Fourth Appellate District of the California Court of Appeal.
