Medicis Settles Off-Label Marketing Charges

Law360, New York (May 8, 2007, 12:00 AM EDT) -- Medicis Pharmaceutical Corp. has agreed to pay $9.8 million to settle charges that it illegally marketed the topical skin preparation Loprox to children.

In a settlement agreement signed last month and announced Tuesday, the U.S. Department of Justice alleged that Medicis urged pediatricians to treat diaper rash with Loprox even though the product was only approved as a fungicide for patients over the age of 10.

Moreover, the DOJ said Medicis violated the False Claims Act by submitting off-label Loprox claims to Medicaid.
