States Open Fight Over Health Care Law In 11th Circ.

Law360, New York (May 4, 2011, 7:19 PM EDT) -- Florida and 25 other states filed their opening brief in the Eleventh Circuit on Wednesday in a dispute over the federal health care overhaul, saying the law's individual mandate clause and its expansion of Medicaid exceeded Congress' constitutional authority.

The case is on appeal from a Florida federal court, which ruled in January that a provision of the Patient Protection and Affordable Care Act that requires all Americans to purchase health insurance or pay a penalty was not protected by the commerce clause of the U.S....
