District Court Denies Abbott's Motion To Dismiss

Law360 (May 9, 2007, 12:00 AM EDT) -- A federal district judge on Tuesday refused to dismiss a lawsuit that accuses Abbott Laboratories Inc. of publishing inflated average wholesale prices for their drugs as a way to bilk Medicare.

Judge Patti B. Saris of the U.S. District Court for the District of Massachusetts ruled Tuesday there was enough evidence for the case to proceed. The qui tam suit was brought by Ven-A-Care of the Florida Keys Inc.
