Merck Unit Sues Sandoz Over Generic Noxafil

Law360, New York (May 6, 2011, 5:05 PM EDT) -- Merck & Co. Inc. subsidiary Schering Corp. lodged a suit Wednesday in New Jersey accusing Sandoz Inc. of infringing three patents by seeking to make and sell a generic version of Schering's fungal infection drug Noxafil.

Schering lodged a complaint against Sandoz — the generic arm of Novartis AG — in New Jersey federal court, seeking a court order withholding U.S. Food and Drug Administration approval of Sandoz's abbreviated new drug application until the patents-in-suit expire.
