Mass. Constitution Protects Legal Immigrants: Court

Law360, New York (May 6, 2011, 7:56 PM EDT) -- Massachusetts' highest court ruled Friday that the state's legal immigrants are protected under its constitution, giving a boost to noncitizen residents who brought a class action to overturn a law barring them from the state's public health insurance program.

In deciding questions certified by a lower court overseeing the citizens' suit, the Massachusetts Supreme Judicial Court ruled that state laws that discriminate against legal immigrants are subject to strict scrutiny.
