Axis Seeks To Avoid Paying Developer's Defense Costs

Law360, New York (May 6, 2011, 7:21 PM EDT) -- Axis Specialty Insurance Co. on Friday said it had no duty to defend or indemnify the developer of a Florida planned community in class actions alleging the developer failed to notify potential homeowners about a nearby former military bombing range.

Axis alleges that the underlying proposed class actions did not assert claims for property damage or bodily injury, and were therefore not covered by the commercial general liability policy it issued to Newland Communities LLC and various affiliates.
