Microsoft, EBay Lose Bid To Nix Web Shopping Patent

Law360, New York (May 10, 2011, 3:55 PM EDT) -- A California federal judge on Monday denied a motion by eBay Inc. and Microsoft Corp. seeking to invalidate an electronic catalog patent held by Kelora Systems LLC.

U.S. District Judge Claudia Wilken ruled that Microsoft and eBay failed to show that claims added to the patent during re-examination render it invalid by impermissibly enlarging the scope of the patent.

The ruling is the latest turn in a complicated dispute where the patent-in-suit was ruled invalid by the same court in a different case, when it was owned by a different company, and was then amended during re-examination.
