NY High Court Revives Restaurant Worker's Lye Case

Law360, New York (May 10, 2011, 4:03 PM EDT) -- New York state's highest court on Tuesday reinstated a product liability case brought by a Manhattan restaurant worker who was seriously injured while using Lewis Red Devil Lye to clear a clogged floor drain.

A trial court had dismissed the case against Reckitt & Colman Inc., its successor Reckitt Benckiser, and Malco Products Inc. — which were responsible for the manufacture, distribution and package design of Lewis Red Devil Lye — on summary judgment, and an appeals court had affirmed.
