Taco Bell Again Fails To Force Arbitration In OT Action

Law360, New York (May 10, 2011, 6:21 PM EDT) -- A magistrate judge in Colorado on Tuesday denied for the second time a Taco Bell Corp. bid to send to arbitration a putative class action accusing the fast food chain of failing to pay assistant general managers overtime.

In denying the motion, Magistrate Judge Kathleen M. Tafoya ruled that Taco Bell never presented evidence that the employee who filed the action signed an arbitration agreement.
