Remington Not Liable For Rifle Explosion: 5th Circ.

Law360, New York (May 19, 2011, 2:13 PM EDT) -- The Fifth Circuit on Wednesday declined to revive a lawsuit against Remington Arms Co. Inc. brought by a man who lost an eye when a rifle exploded, ruling that the company could not be held liable under Louisiana law.

In a split decision, the appeals court affirmed a decision that because Remington could not have reasonably anticipated the rifle would be used after being reassembled with a key part missing, the company was not responsible for the accident under state product liability law.
