Mylan Settles Kentucky Drug-Pricing Suit For $6.5M

Law360, New York (May 20, 2011, 6:46 PM EDT) -- Mylan Laboratories Inc. and Mylan Pharmaceuticals Inc. have agreed to pay $6.5 million to settle claims that they defrauded Kentucky's Medicaid program by lying about average wholesale prices for their drugs, Kentucky's attorney general said Friday.

The generics makers significantly inflated the AWPs in reports to the Kentucky Medicaid program, publishing prices that had no relationship to actual prices paid by customers, Attorney General Jack Conway said. Some of the reported prices were as much as 80 times higher than the actual average price, Conway said....
