Arch Loses Bid To Kill H20's Skin Product Mold Suit

Law360, New York (May 23, 2011, 2:30 PM EDT) -- A New Jersey federal judge refused on Sunday to dismiss H20 Plus LLC’s breach of contract suit alleging Arch Chemicals Inc. sold the company a preservative that failed to prevent mold growth in skin care products and forced a recall.

In an order signed last Tuesday and filed electronically on Sunday, U.S. District Judge William J. Martini rejected Arch’s bid to dismiss the eight-count complaint, finding the breach of contract and fraud suit satisfied Twombly's heightened pleading requirements.
