UK Tribunal Lets Morgan Crucible Off Hook In Cartel Case

Law360, New York (May 25, 2011, 3:29 PM EDT) -- The U.K.'s Competition Appeal Tribunal on Wednesday tossed claims against Morgan Crucible Co. PLC over an alleged carbon and graphite products price-fixing cartel that lasted for 11 years.

Reversing a 2007 decision involving the same scheme and defendant, the tribunal determined that Deutsche Bahn AG brought its complaint against Morgan Crucible after the two-year time limit for filing claims had expired. In its previous ruling, the tribunal allowed similarly tardy complaints against Morgan Crucible brought by Emerson Electric Co.
