Wiccan Chaplain Loses 9th Circ. Appeal On Prison Program

Law360, New York (June 1, 2011, 6:13 PM EDT) -- The Ninth Circuit on Wednesday rejected a Wiccan volunteer chaplain's constitutional and employment discrimination claims against California's corrections department over its program that only pays chaplains of five faiths to minister to inmates.

A three-judge panel ruled that Patrick McCollum lacked standing to bring his First Amendment claims and that his employment discrimination and retaliation allegations lacked merit.
