Judge Invalidates RJ Reynolds Retirement Plan Change

Law360, New York (June 2, 2011, 5:00 PM EDT) -- A federal judge in North Carolina ruled Wednesday that an amendment to an R.J. Reynolds Tobacco Co. retirement plan that eliminated Nabisco stock from the plan was invalid, bolstering plaintiffs' claims in a class action breach of fiduciary duty suit.

U.S. District Judge Norwood Carlton Tilley Jr., who has yet to rule on the merits of the case after an early-2010 bench trial, granted the plaintiffs' motion to amend the complaint to argue that the November 1999 change to the plan was invalid.
