9th Circ. Refuses To Block $1.4B Southwest-AirTran Deal

Law360, New York (June 2, 2011, 6:57 PM EDT) -- The Ninth Circuit dismissed on Thursday an appeal for a temporary restraining order to block Southwest Airlines Co. and AirTran Holdings Inc.'s recently completed $1.4 billion merger over competition fears.

In a brief order, a three-judge panel granted the airlines' motion to dismiss a renewed bid from direct purchasers for a TRO against the combination.

The court ruled that the plaintiffs lacked jurisdiction for their appeal, citing a 1989 decision in which the Ninth Circuit held that appeals of TROs are premature and generally not allowed...
