Home Depot, Martha Stewart Sued Over Carpet Lines

Law360, New York (June 3, 2011, 3:44 PM EDT) -- The company that operates the famed Biltmore Estate sued Home Depot USA Inc. and Martha Stewart Living Omnimedia Inc. in North Carolina federal court Friday, claiming their Biltmore and Vanderbilt lines of carpeting infringe the estate's trademarked name.

The Biltmore Co. says the names of the unauthorized carpets will mislead consumers into thinking the brands are affiliated with the 8,000-acre tourist attraction in Asheville, N.C., built by the Vanderbilt family in the late 19th century.
