CalChamber Loses Appeal Over Prop. 65 Chemicals List

Law360, New York (June 7, 2011, 4:26 PM EDT) -- In a defeat for the California Chamber of Commerce, a state appeals court on Monday affirmed California's method for altering a list of dangerous chemicals mandated by a 1986 law governing public notice of toxic exposure.

While the language of California's Proposition 65 is ambiguous, the state's method for adding to its mandated chemical list fulfills the statute's broad goals, including the aim of informing the public of exposure to carcinogens and chemicals that could cause birth defects, the appeals court found.
