Judge Won't Toss CAA Baytown Suit Against Exxon

Law360, New York (June 7, 2011, 8:52 PM EDT) -- A Texas federal judge on Tuesday refused to dismiss a Sierra Club Clean Air Act lawsuit against Exxon Mobil Corp. over pollution from its oil refinery complex in Baytown.

The Sierra Club claims Exxon's Baytown facility has emitted more than eight million pounds of pollutants into the atmosphere over the past five years, well in excess of legal limits. But Exxon argued in its bid to dismiss that the court should not be involved, since state and federal officials had already made “exhaustive” regulatory efforts....
