Ex-Orrick Atty Denied Punitive Damages In Fraud Suit

Law360, New York (June 7, 2011, 7:20 PM EDT) -- A New York state appeals court on Tuesday refused an ex-Orrick Herrington & Sutcliffe LLP associate's request for punitive damages in a contract and fraud suit alleging the firm tricked him into staying on by promising a promotion.

The court said Patrick Hoeffner's suit was an “ordinary fraud and deceit” suit, and for punitive damages in New York he would have to allege “evil” intent or criminal indifference on Orrick's part.
