FedEx Denied Attys' Fees After Bar Code Patent Win

Law360, New York (June 10, 2011, 9:34 PM EDT) -- A Texas federal court denied FedEx Corp.'s motion for attorneys' fees Friday in a patent infringement suit over bar code technology brought by BarTex Research LLC that FedEx won in February 2010.

In refusing to award attorneys' fees, the court said FedEx failed to prove that BarTex had engaged in litigation misconduct, that the case was exceptional or that BarTex's claims were unreasonable and baseless.

FedEx argued that BarTex's expert witness misquoted FedEx documents and contradicted prior testimony, but the court disagreed, saying that allegation went against the witness, not BarTex....
